Terms and Conditions for Digital Collection

The following Terms and Conditions for Digital Collection apply to your contribution to and use of the Christchurch City Libraries’ digital collection, which is available on the Christchurch City Libraries’ websites. Where there is conflict between the Terms and Conditions for Digital Collection and the Terms of Use for Christchurch City Libraries’ websites (disclaimer, copyright, privacy), the Terms and Conditions for Digital Collection will prevail.

 

Reuse of Images

Our digital collection has been provided for private study purposes (such as school projects, family and local history research), and any published reproduction (print or electronic) may infringe copyright law. Please contact Christchurch City Libraries if you have any questions relating to the use of this material. It is the responsibility of the user to obtain clearance from the copyright holder.

 

Indemnity

It is your responsibility to ensure that your use of the images from the digital collection complies with all applicable law and cultural and moral standards, including laws relating to privacy, indecency and defamation.

The Christchurch City Council is not liable and you indemnify the Christchurch City Council in full (including lawyer's fees), for any claims or expenses arising from use of an image from the digital collection. Where liability cannot be excluded, to the extent permitted by law, the liability of the Christchurch City Council is limited to the amount of any fee payable for use of the relevant image.

By using the images in the digital collection, you agree to the following terms:

 

Personal Use of Images

Unless otherwise stated, images in the digital collection may be reproduced, transmitted or copied in any other way for the purposes of private study, research, criticism, review, or education. Images must be reproduced in full and not cropped or altered in any way, unless Christchurch City Libraries or the copyright holder has given permission for the change.

Acknowledgement of the Christchurch City Libraries and the owner of copyright in the image must accompany any reproduction, transmission or copy of all images together with citation details, e.g.:

Further identifying details, such as title, caption, creator or date, can be found with the image in the digital collection on the Christchurch City Libraries’ websites, or by clicking the 'View more information' link, where this is supplied.

The acknowledgement and citation should be reproduced on the same page as the image, or at the beginning or end of audiovisual resources.

Commercial Use of Images

High-resolution versions of some images are available on request for Commercial Use. Commercial Use means use for any purpose other than private study, research, criticism, review or education. 

Requests for images for Commercial Use are sent to Christchurch City Libraries. To order an image through Canterbury Stories, use the shopping basket icon below the bottom right corner of the image to open the link.

Fees

Christchurch City Libraries reserves the right to charge a fee for any reproduction, transmittal or copying in any other form of the images in the digital collection on the Christchurch City Libraries’ websites. The fee is additional to any charges incurred for processing and supplying the image. All fees must be paid before reproduction or publication of the image.

Terms and Conditions for Commercial Use of Images:

These terms and conditions apply together with, and form part of, the Terms and Conditions for Digital Collections.

On requesting an image for Commercial Use (as defined in the Terms and Conditions for Digital Collections), you agree that:

  • By requesting or downloading an image for Commercial Use you agree to a non-exclusive right to reproduce, transmit or copy the image.
  • You will seek and supply proof of permission from the copyright owner.
  • Unless Christchurch City Libraries has separately agreed to you retaining a copy of the image for a longer period, you must delete all digital or archived copies of the image within 60 days after you have used it for the commercial use for which it was obtained.
  • You agree not to sell, distribute or otherwise deal with the Image or copies of it except strictly in accordance with any permission provided by Christchurch City Libraries. A fee and other terms may apply to any additional use.
  • An acknowledgement to Christchurch City Libraries and the owner of copyright in the image must accompany any reproduction, transmission or copy of an image in the digital collection on the Christchurch City Libraries’ website
  • An appropriate acknowledgement is: © [Owner]. Obtained from the collection, and used with permission of, Christchurch City Libraries. http://christchurchcitylibraries.com/
  • Citation details of the image must also accompany any reproduction, transmission or copy of an image, for example:

Christchurch City Libraries, File Reference: CCL Map 123456; or
Christchurch City Libraries, File Reference: CCL PhotoCD 2, IMG0003

  • Further identifying details, such as title, caption, creator or date, can be found with the image in the digital collection on the Christchurch City Libraries’ websites. The acknowledgement and citation should be reproduced on the same page as the image or at the beginning or end of audiovisual resources.
  • In some cases, Christchurch City Libraries may require that the acknowledgement is not included. If so, you agree to comply with such a requirement.
  • The image must be reproduced in full and not cropped or altered in any way, unless Christchurch City Libraries or the copyright holder has given permission for the change.
  • You will pay the applicable fee prior to being provided with the image.

 

We remind you that, as set out in the Terms and Conditions for Digital Collections, you are responsible for your use of the images.

Linking to our website

If you wish to provide a link to one of the Christchurch City Libraries’ websites from your website, you must do so in such a way that it is clear to users that the pages are part of a Christchurch City Libraries’ website owned by the Christchurch City Council. You must not represent any page on any Christchurch City Libraries’ website in a subframe.

You must not do anything which alters the Christchurch City Libraries’ websites or interferes with how they work. Christchurch City Libraries’ websites, including these terms of use, are changed and updated from time to time.

Trademarks and logos

One exception is trademarks and logos on Christchurch City Libraries’ websites. These are the registered or unregistered trademarks of the Christchurch City Council or others. You must not copy or use our trademarks (including the Council logo), except if you first obtain our written permission.

Third party copyright

Some material on the Christchurch City Libraries’ websites is sourced from third parties. Permission cannot be granted by the Christchurch City Council to reproduce any copyright material available on the Christchurch City Libraries’ websites that is owned by a third party.

Submissions

Christchurch City Libraries provide online and interactive services through other websites which are owned and hosted by third parties. We provide these online and interactive services for you to exchange ideas and information. Any material you transmit or post to Christchurch City Libraries’ websites, or through online and interactive services provided by Christchurch City Libraries through third party websites, including any RSS or Atom feeds and email notifications produced by or via or displayed on them, is known as your “Submissions”.

Use of your submissions

Other than personal information not visible on Christchurch City Libraries’ websites (which is covered under the Privacy Statement) or on third party websites though which online and interactive services are provided (which are covered under each website’s privacy statement), your Submissions will be considered non-confidential. You grant the Christchurch City Council a non-exclusive, royalty-free and irrevocable licence to publish your Submissions in any media and in any format, including on any Christchurch City Libraries’ website or any other website, in hard copy publications, in email notifications and alerts and in RSS, Atom or other feeds.

Your responsibilities

If your Submissions include material in which copyright or other intellectual property is owned by a third party, you warrant that you have the right to use that material.

You are prohibited from posting or transmitting to or from Christchurch City Libraries’ websites, or through online and interactive services provided by Christchurch City Libraries through third party websites, any material that is illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or otherwise injurious or objectionable. We will co-operate fully with any law enforcement authorities or court order requesting or directing us to disclose the identity or locate anyone posting any material in breach of this clause.

Moderation

Submissions may be moderated by Christchurch City Libraries before being published. We may decline to publish Submissions or may modify Submissions if they are considered to be either contrary to the clause above or irrelevant to the subject-matter of the Christchurch City Libraries’ websites or of the online or interactive services provided by Christchurch City Libraries though third party websites.

Termination of access

Christchurch City Libraries reserve the right to terminate a user’s access or ability to post to the comments or submissions areas of Christchurch City Libraries’ websites, or through the online or interactive services provided by Christchurch City Libraries through third party websites, if we believe the commenting facility is being abused.
